Terms & Conditions - Workshops and Events
Overview
This workshop is operated by The Digital Exchange (“we”, “us”, “our”). By purchasing a ticket or attending an event, you agree to these Terms, our Website Terms, and our Privacy Policy(collectively, “Terms”).
SECTION 1 – Event Changes or Cancellations
In the unlikely event The Digital Exchange needs to postpone, relocate, or cancel the workshop due to circumstances beyond our control (such as illness, travel restrictions, or venue issues), all registered attendees will be notified as soon as possible.

If the event is rescheduled, your ticket will automatically transfer to the new date.

If the event is cancelled entirely, a full refund of the ticket price will be issued.

Where a Force Majeure event necessitates that any part of our services be cancelled or postponed, you acknowledge that The Digital Exchange will not be liable for any resulting loss, damage, or associated expenses (including travel, accommodation, or other incidental costs).
SECTION 2A – Ticket Purchase & Payment
All ticket prices are listed in Australian Dollars (AUD) and include GST, unless stated otherwise.
Full payment is required at the time of booking to secure your place.
We reserve the right to cancel any booking where payment has not been received in full.
A booking or credit card processing fee may apply.
Discount codes or promotional offers are single-use only and cannot be combined or applied retrospectively.
Tickets are non-transferable except by prior written agreement (see Section 2B).
SECTION 2B – Refunds, Transfers & No-Shows
Space is limited and venues/catering are booked in advance. For this reason, tickets are non-refundable. and will only be issued if the event is cancelled and not rescheduled.
You may request a refund under Australian Consumer Law if the event is not delivered as advertised.
If you cannot attend, you may transfer your ticket to another person by emailing [email protected] at least 48 hours prior to the event.
In the event of a no-show, all fees paid are forfeited.
SECTION 3 – Travel & Accommodation
Attendees are responsible for arranging and paying for their own travel and accommodation.
The Digital Exchange is not liable for any associated costs (including flights, hotels, or transport) in the event of schedule changes or cancellations.
SECTION 4 – Workshop Materials & Intellectual Property
All workshop content, templates, and resources provided are for your personal and business use only. These materials remain the intellectual property of The Digital Exchange and may not be reproduced, distributed, or resold without prior written permission.
You are granted a non-exclusive, non-transferable licence to use the materials solely within your own business. Sharing, copying, or redistributing these materials outside your organisation is prohibited.
SECTION 5 – Conduct & Participation
We reserve the right to remove any participant behaving inappropriately, without refund. This ensures a safe, respectful, and productive learning environment for all attendees.
Participants must follow venue rules and reasonable directions from staff at all times.
SECTION 6 – Photography & Media Consent
By attending the workshop, you acknowledge that photos and video may be taken for marketing and promotional purposes by The Digital Exchange.
If you prefer not to appear in any media, please notify us in writing at [email protected].at least 48 hours before the event, and advise our team upon check-in.
SECTION 7 – Health, Safety and Accessibility
We aim to create an inclusive and safe experience for all attendees.
Please notify us of any accessibility requirements, allergies, or dietary needs at least five (5) days prior to the event.
While we make reasonable efforts to accommodate requests, we cannot guarantee all requirements can be met.
The content delivered is for educational and informational purposes only and does not constitute legal, financial, or medical advice.
SECTION 8 – Results & Third-Party Platforms
We make no guarantees regarding specific results, income, or performance outcomes from participation in the workshop. Please see our Earnings Disclaimer for further details.
Your results depend on your own implementation, actions and competition at the time.
The Digital Exchange is not responsible for any issues, downtime, or changes relating to third-party platforms such as Meta, Google, Canva or others used within the workshop.
SECTION 9 – Privacy & Data Protection
The Digital Exchange handles personal information in accordance with the Australian Privacy Act 1988 (Cth) and our Privacy Policy.
By purchasing a ticket or attending an event, you consent to:

The collection and use of your personal information for event administration, communications, and marketing purposes.

Receiving event-related communications and updates (you can unsubscribe at any time).
Your personal details will not be sold or shared with third parties except where required to deliver services (e.g., venue providers, payment processors).
You may request access, correction, or deletion of your personal information by emailing [email protected].
SECTION 10 – Liability & Warranties
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law (ACL).
To the extent permitted by law:

Our total liability for any claim relating to the event is limited to the amount you paid for your ticket.

We are not liable for indirect, incidental, or consequential loss, including loss of income, profit, or opportunity.
SECTION 11 – Indemnity
You agree to indemnify and hold harmless The Digital Exchange from any claims, losses, damages, or expenses arising from your breach of these Terms or unauthorised use of workshop materials.
SECTION 12 – Governing law
These Terms of Service and any separate agreements for our services shall be governed by and construed in accordance with the laws of New South Wales, Australia.
You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
SECTION 13 – Changes to Terms of Service
You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website online. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
